Federal (Ed-Flex) Waiver Program

 

Application Instructions

The administrator of a local educational agency (LEA) may apply for a federal waiver to any provision of the Education Flexibility Partnership Act of 1999 (Ed-Flex), if the waiver will enable the LEA to improve its instructional program or operate in a more effective, efficient or economical manner. An application for a federal waiver shall not be construed to supersede or preempt any provisions noted in the Education Flexibility Partnership Act of 1999. It is the LEA's responsibility to determine that implementation of the federal waiver will be compliant with the terms of any court order, collective bargaining agreement or contract by which the agency is bound.
   
The Pennsylvania Department of Education (PDE) shall approve, disapprove or request modifications to the application. PDE shall notify the LEA on the status of the application.
     
  • An application for waiver must include the signature of the administrator and date signed.
  • An application for waiver must include the federal program and section to be waived.
  • An application for Title I waiver must include attached Selection of Schools pages. One page completed without the waiver and one page completed with the waiver.
  • Use additional pages to provide explanations and descriptions for each section.
  • Sections must be clearly identified and all pages must be numbered.
  • Applications must be returned to PDE at the address at the bottom of this webpage.

Waiver Report Instructions

Section 14401(e) of the Elementary and Secondary Education Act (ESEA) requires LEAs to submit a waiver report at the end of the second year of the waiver period and each subsequent year thereafter. The waiver report shall include a description of how the waiver was used, how the LEA continued to serve students in other schools affected by the waiver and the progress being made to improve the quality of instruction and the academic performance of students.
 
  • An explanation and description of each section should be provided.
  • Sections must be clearly identified and all pages must be numbered.
  • The Waiver Report must be returned to PDE at the address at the bottom of this webpage.
